Proto Global, LLC Limited Hardware Warranty

Effective Date: August 14, 2025

These Proto Hardware Limited Warranty terms ("Hardware Warranty Terms") form a legal agreement between you ("You", "your", "Buyer") and Proto Global, LLC ("Proto", "we", "our", or "us"), with its principal place of business at 1955 Broadway, Suite 600, Oakland, CA 94612, United States of America. These Hardware Warranty Terms govern our warranty in relation to Proto's mining hardware ("Hardware"). You understand that your purchase or use of Hardware is subject to these Hardware Warranty Terms.

Proto warrants all Hardware against defects in materials and workmanship under normal use for a period of one (1) year from the date they are made available to Buyer (the "limited Hardware Warranty") if your shipping address is in the US and other jurisdictions outside of the European Union. Proto warrants all Hardware against defects in materials and workmanship under normal use for a period of two (2) years from the date they are made available to Buyer if your shipping address is in the European Union. This warranty is non-transferable and limited to Hardware returned to Proto within the warranty period, which Proto determines to be defective.

Proto will replace such defective Hardware at no cost to you, provided you follow the required steps to file a warranty request with the appropriate supporting evidence. To initiate a warranty claim, contact us via our customer support contact found on our website at proto.xyz. After contact with customer support, Buyer will then return the defective Hardware to Proto's manufacturer, or a location specified by Proto, along with a written explanation of the claimed defect. Once a warranty claim is received and approved, Proto will, at its option and expense, and within a reasonable time period of no more than 90 days, either deliver a replacement to Buyer or refund the purchase price paid for the defective Hardware.

For approved warranty claims, this is your sole and exclusive remedy for breach of this limited Hardware Warranty. This limited Hardware Warranty is only available to You as the original purchaser of Hardware. This limited Hardware Warranty coverage terminates if You sell or transfer your Hardware. No Proto reseller, agent, or employee is authorized to make any modification, extension, or addition to this limited Hardware Warranty.

Proto may use a third-party testing provider to test any returned Hardware. If no defect is identified, Buyer will reimburse Proto for the testing services and pay for any replacement Hardware delivered. Proto will return the non-defective Hardware to Buyer at Buyer's expense, without refund or replacement.

This limited Hardware Warranty does not apply to any Hardware that:

  • has been repaired, disassembled, reverse engineered, altered, or modified in any way;
  • has been “unlocked” to allow for custom software configuration
  • has been "overclocked" beyond Hardware specifications;
  • has been subjected to misuse, abuse, negligence, accident, incorrect installation, or improper storage or operation;
  • has been subjected to operating or environmental conditions deviating from Hardware specifications;
  • has been damaged due to acts of God, static discharge, or electrical surges;
  • has had its serial number(s) defaced, altered, or removed; or
  • has become defective or inoperable due to any defect in any other product, system, firmware, software, or hardware not provided by Proto.

EXCEPT FOR THE REPRESENTATIONS AND WARRANTIES STATED ABOVE, PROTO IS SELLING AND BUYER IS ACCEPTING HARDWARE (INCLUDING ANY THIRD PARTY PRODUCT) "AS IS". PROTO MAKES NO OTHER WARRANTIES OR REPRESENTATIONS WHATSOEVER UNDER THIS AGREEMENT. BUYER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR ARISING BY LAW OR OTHERWISE, WITH RESPECT TO HARDWARE (INCLUDING ANY THIRD PARTY PRODUCT) OR THIS AGREEMENT INCLUDING: (A) ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, TITLE, OR NON-INFRINGEMENT; AND (B) ANY IMPLIED WARRANTY ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE. ADDITIONALLY, PROTO WILL HAVE NO OBLIGATIONS WITH RESPECT TO ANY TECHNICAL SUPPORT, MAINTENANCE, OR REPAIR OF HARDWARE (INCLUDING ANY THIRD PARTY PRODUCT), AND ANY COSTS ASSOCIATED THEREWITH ARE THE RESPONSIBILITY OF BUYER.

If you are an EU resident, our Hardware Warranty Terms do not affect your statutory warranty rights to Hardware that is in conformity with the contract and the applicable statutory remedies in the event it is not, including the right to repair or replacement at no charge.
